Terms of Service

1. What Welaa Is

Welaa is a software platform that helps art and tattoo studios manage client conversations, bookings, commissions, and payments. Studios subscribe to Welaa and use it to communicate with their own clients through messaging channels such as LINE, Facebook Messenger, and WhatsApp.

By creating an account or using Welaa, you agree to these Terms of Service.

2. Account Terms

  • You must provide accurate information when creating an account.
  • One account per person. You may be a member of multiple studio workspaces.
  • You are responsible for maintaining the security of your login credentials.
  • You must be 18 years or older to create a studio account.
  • Welaa reserves the right to suspend accounts that violate these terms or applicable law.

3. Studio Responsibilities

Studios using Welaa are responsible for:

  • Their own client relationships, pricing, service quality, and delivery
  • Complying with applicable laws, including consumer protection, health, and safety regulations
  • Verifying client age for age-restricted services (tattooing, piercing)
  • Obtaining any necessary consents from clients before contacting them via messaging channels
  • Ensuring their use of AI-generated messages complies with messaging platform policies

Welaa provides tools; the studio is responsible for how those tools are used.

4. AI-Generated Content

Some messages sent through Welaa are generated by an AI assistant. Welaa does not guarantee the accuracy, completeness, or appropriateness of AI-generated content. Studios should review AI outputs before sending to clients, particularly for pricing, health-related guidance, or commitments.

Welaa is not liable for any harm arising from reliance on AI-generated messages.

5. Payments

Client payments for studio services are processed through Stripe Connect. The studio is the merchant of record; Welaa facilitates the payment flow but is not a party to the transaction between studio and client.

  • A platform fee applies depending on the studio’s subscription plan.
  • Stripe’s terms and privacy policy apply to all payment processing.
  • Refunds are handled at the studio’s discretion according to their own refund policy.
  • Welaa facilitates refund and dispute workflows but does not guarantee refund outcomes or arbitrate disputes.

6. Intellectual Property

  • Studios retain full ownership of their artwork and creative work.
  • Client-uploaded content (reference images, design files) remains the client’s property.
  • Welaa does not claim ownership over any content you upload or create on the platform.
  • You grant Welaa a limited licence to store and display your content for the purpose of providing the service.

7. Commission Disputes

Disputes over commission artwork, deliverables, revisions, or delivery timelines are between the studio and their client. Welaa provides tools to help manage the commission lifecycle (stage approvals, revision requests, file delivery) but is not an arbitrator and will not adjudicate disputes.

8. Subscription and Billing

  • Welaa is billed on a monthly subscription basis.
  • You can cancel your subscription at any time from the settings page.
  • There are no refunds for partial months already billed.
  • Plan downgrades take effect at the end of the current billing cycle. Some features may become unavailable immediately upon downgrade if limits are exceeded.
  • Welaa reserves the right to change subscription pricing with 30 days’ notice to existing subscribers.

9. Limitation of Liability

Welaa is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, Welaa is not liable for:

  • Disputes between studios and their clients
  • Errors or inaccuracies in AI-generated messages
  • Messaging delivery failures caused by LINE, Meta, or WhatsApp
  • Loss of data due to factors outside our control
  • Indirect, incidental, or consequential damages of any kind

Our total liability for any claim is limited to the amount you paid us in the three months preceding the claim.

10. Termination

Either party may terminate the subscription at any time. Upon termination:

  • Your data remains available for export for 30 days after the termination date.
  • After 30 days, data may be permanently deleted.
  • Welaa may terminate accounts immediately for violations of these terms, illegal activity, or non-payment.

11. Data Export & Portability

You can request an export of your workspace data at any time. The export includes your leads, conversations, messages, bookings, commissions, and Commission files in a machine-readable format (JSON plus original file attachments).

A self-service export button is on our roadmap. In the meantime, email support@welaa.app from the address registered to your workspace and we will prepare the archive within 10 business days. There is no charge for the first export per year; subsequent exports within the same year may incur a small service fee.

Clients of a studio may request a copy of their own personal data at any time by contacting the studio directly or emailing privacy@welaa.app. We respond within 30 days as required by the Thailand Personal Data Protection Act.

12. Governing Law

These Terms are governed by the laws of Thailand. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.

13. Changes to These Terms

We may update these Terms from time to time. We will notify subscribers via email or in-app notification at least 14 days before any material change takes effect. Continued use after that date means you accept the updated Terms.
